'I'm going to murder you'

A BOOZED-UP dad-to-be threatened to murder police officers and their families if they did not let him go.

A furious James Fairley also hurled racial abuse at cops, spat on one and tried to bite another after he was arrested in Bonhill.

Officers on patrol spotted the 19-year-old at 9pm and thought he was wanted for other offences.

But when they tried to talk to Fairley he ran off before becoming aggressive towards them, Dumbarton Sheriff Court heard on Thursday.

Diane McConnell, fiscal depute, told the court he was eventually stopped after a short chase in Northfield Road, near to the golf course.

She added: “The police started questioning him and immediately he was unco-operative with them.

“They asked for some basic details but he started shouting and swearing at them as well as uttering racial remarks towards them.

“He was handcuffed to which he said ‘take these cuffs off me, I will murder you and your family’.”

Despite making it clear that he was being arrested for breaching the peace, Fairley’s abuse continued, before he started struggling violently with officers.

When they were trying to arrest him, back-up was called for to deal with Fairley because he was kicking violently, attempted to headbutt officers and struck his head on the inside cage are of the van.

He was then taken to the Western Infirmary as a precautionary measure.

During the trip to the hospital, Fairley spat in one officer’s eyes before attempting to bite and spit on another.

After being examined the accused was checked out and returned to be detained.

He was not cautioned and charged at the time because of his state.

Roddy Boag, defending, said: “The accused’s position is that he recollects very little of this.

“He had been taking some alcohol but not enough to make him behave in this way and he assumes that something was put in one of his drinks.

“He was previously subject to high tariff disposals when he was sixteen but his domestic situation has substantially changed and he now has his own tenancy and a girlfriend with a child on the way in the near future.”

Fairley pled guilty to breaching the peace, resisting arrest and assaulting two police officers on June 10 this year.

Fairley, of 67 Crown Avenue, Radnor Park, was jailed for seven months and 15 days which will be backdated to June 11.
