A RAGING thug, high on a cocktail of drugs and drink, battered a dad out walking his dog on a summer evening.

On seeing Gary Millar assaulting his victim a passer-by tried to intervene and was also punched by Millar.

And the fired-up 20-year-old — who was on an ASBO — did not stop there.

He also tried to punch a female police officer and bit a male cop on his inner thigh — as the incident played out.

His first victim was left with a burst lip and swelling to his face after being punched and kicked on his head and body.

Millar claimed he had attacked the man because his son owed him money.

Maggie Porter, fiscal depute, told Dumbarton Sheriff Court on Thursday, the complainer was outside his house at around 7.15pm and the accused had been in a car passing by.

The court was told Millar approached the complainer and an argument resulting in the attack.

Mrs Porter added: “People saw what was happening and came to the complainer’s aid.”

The first police officer on the scene was a female and Millar tried to land a punch on the WPC as she tried to arrest him. Scott Adair, defending, said: “Alcohol, cocaine and valium are problems for Mr Millar and he had taken all of these on this day.”

In regard to biting the policeman, Mr Adair added: “My client’s position is that when he was put to the ground by the police officers one of them sat on him while the other sat on his shoulders and put his legs around his head.

“It is at this point that the bite occurred before the police officer moved his leg.”

Millar — who appeared from custody — pled guilty to all four assaults which took place on July 5, this year, at Carroch Crescent, Balloch.

Sentencing, Sheriff Simon Fraser said: “You have had probation, community service, restriction of liberty orders, you are on an ASBO and none of these have worked.

“You just go your own merry way.

“And if you disagree with someone you just swing your fists.

“This was a violent attack on someone with whom you had no quarrel and to add to that you have amongst all your other convictions an assault to severe injury offence.”

Millar, of no fixed abode, was jailed for nine months for all the offences, which will be backdated to July 7.
