A BONHILL man ended up in court after a row with his partner over which of them owned a cheesecake.

Pappert resident Darren Baird, 33, seized his partner on the head and pushed her on the body in the incident at a property at nearby O’Hare on May 17 last year.

Baird appeared for sentencing at Dumbarton Sheriff Court on Friday, February 15, having pleaded guilty at an earlier hearing to a charge of assault.

Fiscal depute Meghan Glancey said: “The accused and the complainer were within her home address. There was an argument in relation to the ownership of a cheesecake.

“The argument continued and the accused grabbed the complainer by the face and pushed her on the chest.

“He immediately apologised and attempted to give her a hug. She contacted police.”

Solicitor Matthew Berlow, defending, told the court sentence had been deferred on his client for an assessment of whether he was suitable for a place on the West Dunbartonshire PAIR programme, which works with people convicted of domestic abuse.

Sheriff Maxwell Hendry told Baird: “The offence on May 17 is not the most serious of its type, but you know you have committed more serious offences of this type in the past, and it is indicative of a more serious problem which needs to be addressed.”

Baird was handed a community payback order (CPO) under which he will be supervised by social workers for two years.

As well as taking part in the PAIR programme, he must also complete 100 hours of unpaid work within three months.

Sheriff Hendry told Baird to come back to court in May for a review of the order and added: “If you are doing well you can reasonably expect the order will be allowed to continue.

“If you are doing badly you can reasonably expect that the order will be brought to an end and that I will be imposing a custodial sentence.”

Baird had also admitted a charge of breaching a bail condition by contacting the same woman via text message on July 19 and 20 last year; sentence on that offence was continued until the date of the CPO review.
